The Court of Appeal of the Republic of Trinidad and Tobago, Justice of Appeal Nolan Bereaux with whom Justices of Appeal Rajkumar and Wilson agreed, recently handed down its written decision in a Civil Appeal that concerned an issue of law, on where the burden of proof lies in Civil Litigation cases and in what circumstances a Court of Appeal would overturn the findings of fact of a first instance trial Judge.
